The National Investigation Agency (NIA) court in Kochi on Friday arrested an Indian national from Kerala who is said to have joined the Islamic State (IS) in Iraq. He has been accused of multiple offences. This is one of the first cases in Kerala where an accused was found guilty under section IPC 125 for waging war against an Asiatic power which is in alliance with India, officials said.

The 36-year-old man was accused of hatching a criminal conspiracy to wage war against the governments of India and Iraq. Subahani has been sentenced to life in prison for waging war against India

Hailing from Kerala, Subahani Haja Moideen was caught on October 5, 2016, from his residence in Thirunelveli in Tamil Nadu after a group of six people was arrested by the NIA from Kananakamala in Kannur, while they were holding a meeting there.

According to the National Investigation Agency, the convict had gone to Iraq and ISIS provided him training. He travelled between April and September in 2015 and returned to India in 2016.

He has also revealed to the NIA that he saw the attackers of the ghastly Paris attack visit his camp in Mosul, Iraq.

According to the chargesheet filed by the National Investigation Agency, Moideen intentionally and knowingly became an ISIS member in April 2015.

He joined the terrorist organisation and waged war against the government of Iraq, an Asiatic power in alliance with the government of India.

During custodial interrogation, he made a big revelation that he had knowingly and intentionally communicated with co-conspirators in ISIS within and outside India over online social media platforms like Facebook and Telegram to wage war against the governments of Iraq and India.

Based on his disclosures, the contents of his email and social media accounts were extracted in the presence of independent witnesses, during custody.
